The short version
These Terms are the agreement between you and us when you use Pivot & Pull. The full Terms below are what count, but here is the heart of it:
- Pivot & Pull is for adults (18 and older) who live in the United States.
- Memberships renew automatically, monthly or yearly, until you cancel. You can cancel any time, and you keep access until the end of the period you already paid for.
- Your first payment comes with a 14-day money-back guarantee. Email hello@pivotpull.com within 14 days to use it.
- What you write in your private development work belongs to you and stays private.
- The Boardroom (Leadership Community) works because people treat each other well. Our Community Standard applies there.
- Pivot & Pull supports your growth as a leader. It is not therapy, counseling, legal advice or HR advice.
1. Who we are and agreeing to these Terms
Pivot & Pull is a leadership development platform operated by Culturally Elevated Consulting, LLC, 24285 Katy Fwy, Suite 300, Katy, Texas 77494 ("we," "us," "our"). These Terms of Use cover pivotpull.com, the Pivot & Pull member platform, our emails, and everything you can do in them (together, "Pivot & Pull").
By creating an account, buying a membership, joining the Early Access list or otherwise using Pivot & Pull, you agree to these Terms and to our Privacy Policy at pivotpull.com/privacy-policy. If you do not agree, please do not use Pivot & Pull.
2. Who can join
- You must be at least 18 years old.
- Memberships are offered to residents of the United States.
- Each account is for one person. Accounts cannot be shared, transferred or sold.
- The information you give us, including your name and email address, must be accurate and kept up to date.
3. Your account
You are responsible for keeping your sign-in private and for what happens in your account. If you think someone else has used your account, email hello@pivotpull.com right away.
After you buy a membership, we email you how to sign in. There is no password: you sign in with a one-time link sent to your email. If a link expires, you can ask for a new one from the sign-in page.
4. Memberships
Pivot & Pull has two memberships: Reclaim the Room and Reclaim the Room Plus. What each one includes is shown on our Pricing page when you buy, and at checkout.
We keep adding to Pivot & Pull. New Pivots, Pulls and features that are part of your plan are included as they are released. Some future features that cost us money to run each time, such as live sessions, may be offered as optional add-ons. We will always tell you the price of an add-on before you choose it.
We may change, improve or retire individual features over time. If we remove something that was a main reason you joined, contact us and we will work with you on a fair solution.
5. Payment and automatic renewal
Payments are processed by Stripe, our payment provider. We never see or store your full card number.
- Your membership renews automatically at the end of each billing period (each month for monthly plans, each year for annual plans) until you cancel.
- By purchasing, you authorize us, through Stripe, to charge your payment method for each renewal at the price in effect for your plan.
- For annual memberships, we email you a reminder about 30 days before your renewal date.
- Prices do not include any sales tax that may apply. If tax applies, it is shown before you pay.
- If a renewal payment fails, we will let you know and give you a chance to update your payment method. If it is not resolved, your access may pause until it is.
Price changes
We may change membership prices. If a change affects your membership, we will email you at least 30 days before it applies, and it will only apply from your next renewal. You can cancel before then if you do not want to continue at the new price.
6. Early Access and Founders' Pick rates
From time to time we offer special rates, such as Early Access pricing or an invitation to Founders' Pick. The details of each offer, including how long the special rate lasts, are shown when you accept it. These rules apply to every special rate:
- A special rate lasts for the period stated in the offer. After that, your membership continues at the public price in effect at that time, unless the offer says otherwise.
- If you cancel, or move to a lower plan, the special rate ends. If you come back later, you pay the public price at that time.
- A special rate locks the price, not the features. New features are included or offered as described in section 4.
- Invitations and offer codes are personal. They cannot be shared, transferred or sold, and each person can use an offer only once.
- A free period (for example, the Founders' Pick free period) ends on the date stated in your invitation. Nothing is charged unless you choose to continue as a paying member.
7. Canceling your membership
You can cancel at any time from Account and Billing inside the platform, or by emailing hello@pivotpull.com. Canceling stops future renewals. You keep access until the end of the period you already paid for, and then your membership ends.
Apart from the money-back guarantee in section 8, we do not give refunds or credits for partial months or years, or for time you did not use.
Canceling your membership does not delete your account. To delete your account and your information, see "Closing your account and deleting your data" in our Privacy Policy.
8. 14-day money-back guarantee
- The guarantee applies to your first payment for a Pivot & Pull membership, including Early Access purchases.
- To use it, email hello@pivotpull.com from the email address on your account within 14 days of that first payment. You do not have to give a reason.
- We refund the full amount of that first payment to your original payment method, and your membership ends.
- The guarantee can be used once per person. It does not apply to renewals, to later purchases after a refund, or to add-ons unless the add-on offer says so.
9. Changing your plan
If you move up from Reclaim the Room to Reclaim the Room Plus, the change takes effect right away. Stripe charges or credits the difference for the rest of your current billing period.
If you move down from Reclaim the Room Plus to Reclaim the Room, the change takes effect at your next renewal, and you keep Plus until then. Any special rate ends when you move down (see section 6).
10. The free Pivot and the Early Access list
Joining the Early Access list is free and is not a purchase. People on the list may receive a free Pivot through a personal link. That link is yours: anyone who has it can open your free Pivot and see your answers, so please do not share it. We may end free offers at any time.
11. How you may use Pivot & Pull
We give you a personal, limited, non-transferable right to use Pivot & Pull for your own leadership development while your account is in good standing. You may print and download the documents Pivot & Pull makes for you (such as your briefs, guides and certificates) for your own use, and share your own credentials.
You agree not to:
- share your account or sign-in, or let anyone else use your membership;
- copy, sell, resell, publish or teach Pivot & Pull content (including Pivots, Pulls, assessments, guides and their wording) to others, or use it to build a competing product or program;
- scrape, download in bulk, or copy the platform by automated means, or use its content to train artificial intelligence models;
- try to get around security, access limits, plan limits or invitation rules, or reverse engineer the platform;
- use Pivot & Pull in a way that breaks the law or harms other people.
12. Your content
You own what you create in Pivot & Pull: your reflections, answers, plans, notes and posts ("your content"). You give us permission to store, process and display your content only as needed to run Pivot & Pull for you, in the way described in our Privacy Policy.
- Your private development work (your assessment answers, reflections, plans and Growth Ledger) is private to you. We do not share it with other members, your employer or anyone else.
- What you post in The Boardroom (Leadership Community) can be seen by other members, as described in our Privacy Policy.
- If you send us ideas or suggestions, for example through the Suggestion Box, we may use them to improve Pivot & Pull without owing you anything.
- We will only publish your words, such as a testimonial or review, with your permission.
13. The Boardroom (Leadership Community)
The Boardroom is a members-only community. To keep it a place where leaders can speak openly, everyone who takes part agrees to our Community Standard, which is shown inside The Boardroom. In short:
- Treat other members with respect. No harassment, threats, hate, or personal attacks.
- Protect other people's privacy. Do not share confidential information about your employer, colleagues, clients or other members, or anything that identifies them without their permission.
- Keep what members share in The Boardroom inside The Boardroom.
- No selling, recruiting, spam or self-promotion unless a space is set up for it.
- Do not pretend to be someone else.
You can post anonymously, which hides your name from other members. Our moderators can still see who wrote an anonymous post, so that reports can be handled. We may remove content, and limit, pause or end someone's access to The Boardroom, if they break the Community Standard. You can report a post or a member from inside The Boardroom.
14. Peer Perspective
Peer Perspective, where your plan includes it, lets you invite people you work with to give anonymous feedback. Please invite only people who know your work and would welcome the request, and do not try to work out who said what. People you invite are covered by our Privacy Policy, and their email addresses are deleted when the feedback cycle closes.
15. Practice recordings
Some activities let you record yourself practicing out loud. A recording is made in your own browser, and it is kept on our servers only if you choose to save it. Please record only yourself.
16. Not professional advice
Pivot & Pull is education and leadership development. It is not therapy, counseling, coaching for mental health, medical, legal, financial, employment or human resources advice. Assessment results, patterns and recommendations are tools for reflection, not diagnoses or judgments about you. You decide how to act at work, and the results of those choices are yours. We do not promise any particular outcome, such as a promotion or a raise.
If you are in crisis or thinking about harming yourself, call or text 988 (the Suicide & Crisis Lifeline in the United States), or call 911 in an emergency.
17. What belongs to us
Pivot & Pull and everything in it that we created (including the Pivots, the Pulls, the Leadership Starting Point, assessments, guides, wording, designs, images, the names "Pivot & Pull," "The Pivots," "The Pull," "Reclaim the Room" and "The Boardroom," and our logos) belong to Culturally Elevated Consulting, LLC and are protected by law. These Terms do not give you ownership of any of it.
18. Suspending or ending access
We may suspend or end your access if you seriously or repeatedly break these Terms, if your payment cannot be collected, or if we have to for legal reasons. Where it is reasonable, we will tell you why and give you a chance to fix the problem first. If we end a paid membership without a breach on your part, we will refund the unused part of your current paid period.
You can stop using Pivot & Pull at any time. What happens to your information when you leave is explained in our Privacy Policy.
19. Disclaimers
We work hard to keep Pivot & Pull useful, accurate and available, but it is provided "as is" and "as available." To the extent the law allows, we do not make promises beyond those in these Terms, including promises that Pivot & Pull will always be available, error-free or right for your situation.
20. Limits on our liability
To the extent the law allows, Culturally Elevated Consulting, LLC will not be liable for indirect, incidental, special or consequential losses, or for lost profits, lost opportunities or harm to reputation, arising from your use of Pivot & Pull. Our total liability for any claim about Pivot & Pull is limited to the amount you paid us for Pivot & Pull in the 12 months before the claim. Some places do not allow these limits, so they may not all apply to you.
21. Your responsibility to us
If someone makes a claim against us because of content you posted or because you broke these Terms or the law, you agree to cover our reasonable costs of dealing with that claim, to the extent the law allows.
22. Governing law and resolving disagreements
If you have a concern, please email hello@pivotpull.com first. Most problems can be solved quickly that way, and we will try in good faith for at least 30 days before either of us goes further.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be handled in the state or federal courts located in Texas, and you and we agree to those courts' jurisdiction. Nothing here takes away any right you have under the consumer protection laws of the state where you live.
23. Changes to these Terms
We may update these Terms as Pivot & Pull changes. We will change the "Last updated" date above, and if a change is significant, we will tell members by email or in the platform at least 30 days before it takes effect. If you keep using Pivot & Pull after a change takes effect, the updated Terms apply. If you do not agree, you can cancel before then.
24. The rest of the fine print
- These Terms, together with our Privacy Policy and the details of any offer you accept, are the whole agreement between you and us about Pivot & Pull.
- If any part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce part of these Terms right away, we can still enforce it later.
- You may not transfer your membership or these Terms to anyone else. We may transfer them as part of a sale or reorganization of our business, and we will tell you if that happens.
